What is your personal situation? It determines if you have to apply for a right of residence under the withdrawal agreement, a residence card for a family member of an EU citizen, or a residence permit.

If you moved to Finland before 1 January 2021 and you are  

  • an employee
  • self-employed
  • a student
  • or a person who has a sufficient income for living in Finland
    • The source of your income does not matter. It may also be your spouse’s income which he or she uses to support you and your family members in Finland.

You have preconditions for being granted a right of residence under the withdrawal agreement in your own right. Depending on your situation, you should apply for

If you do not meet the above conditions for being granted a right of residence under the withdrawal agreement in your own right,

depending on your situation, you should apply for a residence card for a family member of an EU citizen or a residence permit.

Apply for a residence card for a family member of an EU citizen if 

  • your Finnish spouse has been living in another EU Member State for more than 3 months, and 
  • the relationship that led to you becoming family members began during that time.  

In this case, your spouse has used their right of free mobility, and you can consequently apply for a residence card for a family member of an EU citizen. Read the instructions for applying at migri.fi/en/residence-card-for-family-members.

Apply for a residence permit if

  • the relationship which resulted in you and your Finnish spouse becoming family members did not begin in another EU Member State, or
  • your spouse did not stay in the EU Member State where the relationship which resulted in you and your Finnish spouse becoming family members began for more 3 months.
